
THE ATTORNEY GENERAL'S HOME SOLICITATION TIP SHEET
If you buy an item in your home or at a location that is not the seller’s permanent place of business, you may have the option of canceling the sale. The Arkansas Home Solicitation Sles Act, otherwise known as the “3 Day Cooling-Off Rule” may give you three days to cancel purchases of $25. or more. Under this law, your right to cancel the purchase and demand a full refund extends until midnight of the third business day after the sale.
Under the Cooling-Off Rule, the salesperson must inform you of your cancellation rights, and give you two copies of a cancellation form as well as a copy of your contract or receipt.
Helpful Hints in Home Solicitations:
Be wary of salespersons that start their sales pitch by saying that they are "just taking a survey" or "trying to get rid of extra inventory."
Look very closely at deals that offer "free gifts" and that depend on the purchase of another product or a packaged deal.
Do not ever let a salesperson into your home unless you have seen proper identification and determined exactly what he or she wants.
No matter how attractive an offer appears, refrain from making an immediate purchase. It is wise to take a couple of days to consider the actual offer or deal presented.
Take the time to compare the salesperson's price and product with others.
• The 3 Day Cooling-Off Rule does not apply to all home solicitations.
DO NOT BE AFRAID TO SAY, "NO!"
